3 Ways to Hold Title in Missouri

Tenants in Common

Any two or more people, related or not related. In effect, each person owns an undivided interest. Upon the death of an owner, their interest goes to their heirs - NOT the other tenant in title. Tenants in Common is created by saying "as tenants in common" after the names of the grantee in a deed, or by simply not stating any kind of tenancy.

Joint Tenants

Any two or more people, related or not related. In effect, each person owns an undivided interest. Upon the death of an owner, their interest goes to the other title holder, NOT to their heirs. Joint Tenants is created by saying "as joint tenants with right of survivorship" after the grantees names in a deed. Sometimes it may say "as joint tenants with right of survivorship and not as tenants in common."



Tenants By The Entirety

Only a husband and wife can be Tenants by the Entirety. It means they both own the whole interest in the property together as one entity - they do NOT each own half of the interest. Since they each own the whole, upon the death of one of the tenants, the other tenant still owns the full interest in the property. Tenants by the Entirety does provide one of the parties some protections against the actions of the other party. Tenants by the Entirety is created by simply saying "Husband and Wife" after the names of the grantees in a deed.
